Terms & Conditions

These terms govern your use of the Pub & Grub website, future mobile applications, accounts, venue tools and related discovery services.

1. About these terms

Pub & Grub South Africa ("Pub & Grub", "we", "us" or "our") operates a discovery platform for restaurants, pubs, cafés, venues, specials, events, functions and entertainment. These Terms & Conditions apply to visitors, registered users, contributors, venue owners, business representatives and anyone using a service that links to them.

By accessing or using Pub & Grub, you agree to these terms. If you use Pub & Grub for a business or venue, you confirm that you are authorised to accept these terms on its behalf. If you do not agree, do not use the service.

2. What Pub & Grub does

Pub & Grub helps people discover venues and information such as opening hours, menus, facilities, specials, events, functions, entertainment and time-sensitive Pulse updates. Unless we expressly state otherwise for a particular service, Pub & Grub is not the venue, restaurant, pub, event organiser, booking provider, ticket seller, caterer or supplier of the food, drinks, entertainment or venue services shown on the platform.

A listing, badge, placement, review, rating or featured position is not a guarantee, endorsement or warranty. Any contract for a booking, meal, event, ticket, promotion or other venue service is normally between you and the relevant venue or third party.

3. Website, mobile apps and accounts

These terms apply to the current website and to future Pub & Grub iOS or Android applications and account features. You must provide accurate information, keep account access secure and promptly tell us if you suspect unauthorised use. You are responsible for activity performed through your account unless applicable law provides otherwise.

Do not share passwords, access codes or owner permissions with unauthorised people. Some features may require authentication, location permission, an eligible device or acceptance of additional feature-specific terms.

4. Venue and business accounts

If you apply for, claim or manage a venue profile, you confirm that you are authorised to represent the business and that submitted business, contact, menu, price, special, event, booking and facility information is accurate and kept reasonably current. A submission does not guarantee approval, publication, ranking, promotion or continued availability. We may seek verification before granting or retaining management access.

5. Listings and third-party venue information

Listing information may come from venues, users, public business sources or Pub & Grub research. We aim to present useful information but cannot guarantee that every third-party detail is complete, current or error-free.

Prices, menus, specials, opening hours, age restrictions, events, performers, availability, capacities, facilities and booking conditions can change at short notice. Confirm important details directly with the venue or organiser before travelling, booking, paying or relying on them.

6. Specials, promotions, events and Pulse updates

A special, promotion, event or Pulse may be limited by date, time, stock, capacity, eligibility or venue-specific conditions. A Pulse is a time-sensitive update supplied for discovery and may expire or be changed by the venue. Unless Pub & Grub expressly identifies itself as the promoter or organiser, the relevant venue or named third party is responsible for the offer or event.

Displaying an offer does not guarantee that it remains available. Ask the venue about current prices, exclusions, booking requirements and availability.

7. Bookings, enquiries and payments

Pub & Grub may help you contact a venue, open a booking link, send an enquiry or discover a third-party booking service. Unless specifically stated, we do not receive or accept the booking, control venue capacity, hold a reservation, process payment or guarantee a response.

Check the identity, terms, cancellation policy and payment requirements of the venue or third-party provider before completing a transaction. Messages sent through email, telephone, WhatsApp or an external platform are also subject to that provider's terms and privacy practices.

8. Reviews and ratings

Reviews and ratings must be honest, relevant and based on a genuine first-hand experience. You must not submit fabricated, incentivised without disclosure, retaliatory, unlawful, defamatory, discriminatory, threatening or harassing content, or content that reveals another person's private information.

Reviews represent their authors' opinions, not Pub & Grub's. Submission does not guarantee publication. We may verify, moderate, reject, limit, label or remove reviews to protect users, venues and the integrity of the service.

9. Photos and other user-uploaded content

You retain ownership of content you submit. You confirm that you created it or have all rights and permissions needed to share it, including permission from identifiable people where required. Do not upload private, unlawful or infringing material.

You grant Pub & Grub a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for technical or layout purposes, display and distribute submitted content only as reasonably necessary to operate, promote and improve Pub & Grub and the relevant listing or feature. This licence ends when the content is deleted from active systems, except for protected backups, legal records or content already shared in accordance with these terms.

10. Acceptable use

You may not:

  • Break the law, infringe rights or encourage dangerous or unlawful conduct.
  • Impersonate another person or business, misrepresent affiliation, or submit false venue or account information.
  • Harass, threaten, discriminate against, defame or exploit another person.
  • Upload malware, interfere with security, probe for vulnerabilities or attempt unauthorised access.
  • Scrape, copy or harvest content or personal information at a scale that burdens the service, bypasses safeguards or supports a competing database without permission.
  • Manipulate rankings, reviews, ratings, traffic or account activity.
  • Use Pub & Grub branding, content or data for unauthorised commercial activity.

11. Moderation and removal

We may review, fact-check, decline, edit for formatting or safety, label, restrict or remove listings, reviews, photos, Pulses, account content or links that breach these terms, create legal or safety risk, appear misleading, are outdated, or harm the service's integrity. Where practical and appropriate, we may invite clarification or correction. We are not required to monitor every submission before it appears.

12. External links and third-party services

Pub & Grub may link to venue websites, maps, social networks, menus, messaging services, ticketing or booking platforms and other third-party services. We do not control those services and are not responsible for their availability, security, content, pricing, terms or privacy practices. A link does not imply endorsement. Use third-party services at your discretion and review their terms.

13. Intellectual property

The Pub & Grub name, logos, platform design, software, databases, original editorial content and other materials supplied by us are owned by or licensed to Pub & Grub and protected by applicable intellectual-property law. Third-party names, logos, photos and content remain the property of their respective owners.

We grant you a limited, revocable, non-transferable right to use the service for lawful personal discovery or authorised business management. No other rights are granted. Contact us before reproducing or commercially using Pub & Grub material.

14. Service availability and changes

We may add, change, suspend or discontinue features, supported devices, content categories or integrations as the platform develops. We aim to keep Pub & Grub available and secure but do not guarantee uninterrupted, error-free or permanently available service. Maintenance, network failures, security events and circumstances outside our reasonable control may affect access.

15. Accuracy and warranties

Pub & Grub is provided as a discovery and information service. To the extent permitted by law, it is provided on an "as available" basis without guarantees that third-party information is complete, current, suitable for a particular purpose or free from error. Nothing in these terms excludes an express commitment we make in writing or any warranty or consumer right that cannot lawfully be excluded.

16. Limitation of liability

To the fullest extent permitted by South African law, Pub & Grub is not liable for indirect or consequential loss arising solely from reliance on outdated third-party venue information, an external service, a venue's acts or omissions, or an event outside our reasonable control. Pub & Grub does not accept liability on behalf of a venue, organiser, booking provider or other independent third party.

Nothing in these terms limits liability for fraud, gross negligence, wilful misconduct, death or personal injury where liability cannot lawfully be limited, or any right or remedy that the Consumer Protection Act 68 of 2008 or other applicable law does not permit us to exclude.

17. Indemnity

To the extent permitted by law, you agree to compensate Pub & Grub for reasonable losses, liabilities and costs directly resulting from your unlawful content, your material breach of these terms, or your infringement of another person's rights. This does not require you to compensate us for our own negligence or conduct, and it does not limit any non-waivable consumer rights.

18. Suspension and termination

You may stop using Pub & Grub at any time and may request account deletion subject to our Privacy Policy. We may warn, restrict, suspend or terminate access where reasonably necessary because of a serious or repeated breach, fraud, impersonation, security risk, legal requirement or harm to users or the platform. Where practical and lawful, we will give notice and an opportunity to address the issue. Terms that by their nature should continue, including intellectual property, liability and dispute provisions, survive termination.

19. Privacy and cookies

Our Privacy Policy explains how we process personal information, and our Cookie Policy explains cookies and similar technologies. These policies form part of the rules governing the service.

20. Changes to these terms

We may update these terms to reflect service, legal or operational changes. We will post the updated terms, change the last-updated date and provide additional notice where a material change requires it. Continued use after an updated version takes effect means the updated terms apply, subject to any consent or notice required by law.

21. South African law and disputes

These terms are governed by the laws of the Republic of South Africa. Before starting formal proceedings, please contact us so we can try to resolve the issue in good faith. Nothing prevents either party from seeking urgent relief or using a regulator, consumer-protection body, ombud or court with lawful jurisdiction.

Nothing in this section deprives a consumer of a right to approach a forum or court available under the Consumer Protection Act or other applicable law.

22. General

If a provision is found unlawful or unenforceable, it will be limited or removed only to the extent necessary and the remaining provisions will continue. A delay in enforcing a right is not a waiver. You may not transfer your account or obligations without our permission; we may transfer these terms as part of a genuine reorganisation or transfer of the service, subject to applicable law.
